A review of the existing practice of application of pre-trial detention in Poland

More than 10 years ago, the European Court of Human Rights issued a judgment in the case of Kauczor v. Poland, in which ECtHR for the first time held that the problem of abuse of pre-trial detention in Poland is of a structural nature. In recent years, the number of persons held in pre-trial detention for more than one year has increased from 38 in 2016 to 161 in 2018. The report demonstrates that the problem is yet to be resolved.
